SMITHERS, WV (LOOTPRESS)— Two men were arrested after a domestic dispute in Smithers turned physical late Saturday night, with a woman telling deputies she and her son had been threatened and attacked.
According to a criminal complaint, a Fayette County deputy responded to a home on Virginia Avenue around 11:20 p.m. on October 17, 2026. A neighbor had called 911 after someone came to their home reporting that his stepfather had become violent with him and his mother.
When the deputy arrived, he heard a loud argument and found Robert Fogle standing in the road arguing with his girlfriend, Jamie Epperson, who was on the front porch.
The deputy reported that Fogle had a black eye, blood on his face and scratches on his neck, face and arm. Fogle told the deputy that his stepson, Cody Fischer, had attacked him during an argument and punched him several times. He said some of his injuries came from the family dog, which became startled during the confrontation.
Epperson gave a different account, telling the deputy that Fogle had been drinking and making threats to harm or kill her and Fischer. She said Fischer confronted Fogle about the threats and that Fogle punched Fischer, prompting Fischer to fight back.
Epperson told the deputy that after the men separated, Fogle punched her in the face. The deputy reported observing swelling on her left cheek and cuts on both arms.
Fischer also told the deputy that Fogle had repeatedly threatened him and his mother. He said Fogle punched and attacked him when confronted, and that he responded by punching Fogle multiple times. The deputy noted scratches on Fischer’s ribs and shoulders.
Fogle was arrested and taken to Plateau Medical Center for medical clearance before being transported to Southern Regional Jail. Fischer was also arrested and taken to the jail.
