FAYETTEVILLE, WV (LOOTPRESS) – A man was sentenced to prison on Monday following failure to appear in court – a felony offense.
Fayette County Prosecuting Attorney Anthony Ciliberti Jr. reports that on Tuesday, February 6, 2023, Jedidiah T. McMahan – age 36 – was sentenced by Chief Circuit Judge Paul M. Blake Jr. to 1 to 5 years in prison for the felony crime of failure to appear.
The sentencing follows a December 14, 2022 conviction following a one-day trial. McMahan will reportedly be eligible for parole after serving one year in prison.
A jury trial was scheduled in the case of State v. McMahan for felony sex crimes on October 27, 2021. Despite having been informed of the trail date at a previous hearing, McMahan failed to appear for the trial.
The defendant was arrested in May of 2022 in Texas and was extradited back to West Virginia to face trail in both matters. McMahan’s felony sex offense charges remain pending.
This case was investigated by the Fayette County Sheriff’s Department Detective Bureau with extradition assistance from the US Marshals CUFFED Task Force. The case was prosecuted by Assistant Prosecuting Attorney Sarah F. Smith.
