CHARLESTON, WV (LOOTPRESS) — A newly introduced bill in the West Virginia Senate would expand the state’s indecent exposure law to include situations involving biological males undressing in women’s locker rooms.
Senate Bill 1039, introduced during the 2026 regular legislative session and referred to the Senate Judiciary Committee, proposes amending existing state code governing crimes related to indecent exposure.
Under the proposal, the definition of indecent exposure would be broadened to specifically include instances in which a biological male undresses in a women’s locker room if the conduct is likely to cause alarm or offense.
Current law already makes it a crime to intentionally expose sex organs or engage in acts for sexual gratification under circumstances likely to cause affront or alarm. The bill would add the locker room provision to that existing statute.
Penalties for indecent exposure would remain the same under the legislation, generally classified as a misdemeanor punishable by fines, jail time, or both, with stronger penalties for repeated offenses or incidents involving sexual gratification.
Lawmakers say the purpose of the bill is to expand the indecent exposure statute to cover these additional situations. The measure will now be considered by the Senate Judiciary Committee before any further action.
