CHARLESTON, WV (LOOTPRESS) – The state Supreme Court wasted little time today in denying a petition by the Wayne County Republican Executive Committee.
In a brief order that will be followed by more detail later, the court denied Wayne Chairman Jeff Maynard’s motion to issue a Writ of Mandamus against Governor Jim Justice.
The Writ would have effectively forced the governor to choose a new delegate from House District 19 from a list compiled by the county committee. Justice had picked Joshua Booth from a list provided by the state executive committee. The court had stayed that appointment when it agreed to hear the Writ case. Today’s order also lifted that stay and Booth is now a delegate.
He is filling the seat held briefly by Derrick Evans, a newly-elected delegate who resigned after entering the U.S. Capitol on January 6 and was charged with federal crimes.
The court expedited their decision because of the Wednesday start of the new legislative session.
