BECKLEY, WV (LOOTPRESS) — A Raleigh County man is facing a domestic battery charge after police say he struck his daughter during an alcohol-fueled altercation inside a Beckley home.
According to law enforcement, officers responded to a home in Beckley on Saturday, July 26, following a report of a physical domestic incident. The victim, who contacted Raleigh County EOC, claimed her father, Brian Mains, had been drinking and struck her in the face.
When officers arrived, they found Mains seated in the living room. He denied any physical altercation but appeared highly intoxicated, with slurred speech and bloodshot, watery eyes, according to police. Officers also located a loaded Bersa Thunder .380 handgun on the floor near where Mains was sitting.
The victim told officers that Mains attempted to punch her, then slapped her neck. She also reported that he slapped her on the back the day before, an area that had been sunburned. Officers observed visible redness on her neck, which supported her account.
She was transported to Magistrate Court, where she obtained an emergency domestic violence protective order (DVP) against Mains. The order was served while Mains was being processed at the police department.
Due to the evidence and the victim’s injuries, Mains was arrested and charged with Domestic Battery – First Offense. The firearm was taken into evidence for safekeeping. He was then transported to Southern Regional Jail.
