DANVILLE, WV (LOOTPRESS) — A Danville man is facing additional charges after deputies say he violated a court-ordered no-contact condition just weeks after being arrested in a domestic assault case involving the same victim.
According to a criminal complaint from the Boone County Sheriff’s Office, deputies were first dispatched to a residence on Heywood Lane around 11:50 p.m. on November 5, 2025, for a reported domestic violence incident.
When the responding deputy arrived shortly after midnight, a witness reported that the suspect — identified as Justin Scott Abernathy — fled the scene after learning law enforcement was on the way. The witness told authorities that Abernathy had allegedly been striking the door and sides of the residence with a baseball bat while threatening his niece, the victim.
The deputy searched the area but was unable to locate Abernathy that night.
The victim later told deputies she had kicked Abernathy out of her residence weeks earlier and that he had continued threatening her. She also reported that, days before the incident, Abernathy allegedly broke into her home and fell asleep inside her closet.
On November 13, 2025, Abernathy was arrested on a charge of domestic assault involving the same victim. He was later released on bond under the condition that he have no contact — direct or indirect — with her.
However, investigators say Abernathy violated that order on December 25, 2025, when he went to the victim’s residence and attempted to force his way inside by kicking the front door.
The complaint states that Abernathy also broke through a wooden panel to enter the crawlspace beneath the home, where he allegedly tore off ductwork and tried to push out a floor vent in an attempt to speak with the victim. Deputies said his actions placed the victim in fear for her safety.
Additional charges related to the bond violation have been filed, according to the complaint.
