FAYETTEVILLE, WV (LOOTPRESS) – A Glen Jean man has been sentenced after failing to register as a sex offender, a felony offense.
According to Fayette County Prosecuting Attorney Anthony Ciliberti Jr., Byron D. Shelton, 48 of Glen Jean, was sentenced by Judge Thomas H. Ewing on Friday, January 13, 2023 to two sentences of 1 to 5 years in prison for two counts of failure to register as a sex offender required to register for life.
Execution of the second sentence was suspended by Judge Ewing, which means that following the prison sentence Shelton must serve three years of probation.
Shelton plead guilty to the offenses in question on August 18, 2022, and must serve a minimum of one year in prison before becoming eligible for parole.
Shelton changed his phone number in 2021 without notifying State Police within the required time period. Additionally, in March, 2022, Shelton failed to notify police in the required time period upon his release from incarceration on charges unrelated to his sex offender status.
Shelton is required to register as a sex offender for life based on a 1998 conviction of third-degree sexual assault.
This case was investigated by the West Virginia State Police and was prosecuted by Assistant Prosecuting Attorney Sarah F. Smith.
