SAINT ALBANS, WV (LOOTPRESS) – An Album Creek couple faces charges following a vehicle stop on Thursday during which a 5-month-old baby was discovered in the lap of the passenger unrestrained as the vehicle was in motion.
The Kanawha County Sheriff’s Office reports that, at around 2:35am on Thursday, May 11, 2023, Lieutenant D.J. Roush observed a silver Mitsubishi Outlander traveling east while conducting patrols in the MacCorkle Avenue area. Notably, the vehicle’s lights were not operational at the time, despite the time of day and conditions being such as to require headlights for safe travel.
An inquiry with the Department of Motor Vehicles revealed that the vehicle in question had been reported stolen. Upon learning of this, Lt. Roush conducted a traffic stop on the vehicle.
25-year-old Brian Oglesbee was found to be the driver of the vehicle, which was also occupied by a female passenger holding a 5-month-old infant in her lap during travel. The passenger was not wearing a seatbelt, and the driver identified the infant child as his daughter.
Corporal S.M. Adams provided assistance with the investigation and noticed Oglesbee to showing various signs of impairment. He would later admit to having smoked marijuana and methamphetamine prior to operating the vehicle. He was also found to be in possession of multiple controlled substances and paraphernalia.
A DUI investigation was initiated, and Oglesbee was determined to have been under the influence and in no condition to safely operate a motor vehicle. He was also found to be operating the vehicle despite a lack of a valid driver’s license.
Oglesbee was arrested for driving without a valid driver’s license, driving without headlights, two counts of simple possession, driving under the influence with a minor, receiving or transferring a stolen vehicle, and child neglect creating substantial risk of injury. Oglesbee was transported to South Central Regional Jail to await arraignment by a Kanawha County Magistrate.
Later, a warrant was filed in Kanawha County Magistrate Court against the passenger in the vehicle and the child’s mother, Jozelyn M. Pauley, 20 years old of Alum Creek. Pauley had also admitted to deputies that she had smoke marijuana prior to the aforementioned traffic stop.
Pauley was arrested by deputies on Tuesday, May 16, 2023, and was arraigned in Kanawha County Magistrate Court on a child neglect offense. A $2500 cash bond was set, and Pauley is currently being held at South Central Regional Jail, where Oglesbee also remains on a $5000 surety/cash bond.
