MERCER COUNTY, WV (LOOTPRESS) – A man is facing charges after he allegedly sexually assaulted another man while he was unconscious.
According to West Virginia State Police, on Saturday, April 9, 2023, they responded to a home in Brush Fork, WV, located in Mercer County, about a sexual assault that had just occurred. The victim told police he had been drinking alcohol with his friend, Daniel Vaden, 47, of Northfork, when he passed out.
The victim said that he passed out on the bed in the bedroom at the end of the trailer when he awoke to Vaden performing oral sex on him. The victim said he immediately began defending himself.
Police say that Vaden was sitting in a chair in the kitchen area, and he was bleeding from his left ear and had marks on his face. The glass top stove was broke, and pieces of glass were on his face.
Vaden told police that his friend passed out drunk on the bed with his feet on the floor in the bedroom. He said he went to the bedroom and began “playing with him.” Vaden said he started performing oral sex for “about 4 to 5 minutes.” Vaden said his friend woke up, and they both began to fight.
Vaden was transported to Princeton Community Hospital for his injuries, and he further told the same story. He also added that his friend was passed out and unable to consent to the sexual contact. He also told police that there had been no conversations about sex between the two of them. Vaden said after the fight, his friend took him to Rons Quick-Stop, located in Tazewell, Virginia, and “drained” his bank account for around 80 dollars. Vaden said his friend wanted him to sign his vehicle to him in exchange for not contacting law enforcement, but he refused. The sexual assault wasn’t reported until two hours later, and then the victim refused to leave home.
A mouth swab was performed and sent to the WV State Police Crime Lab for testing. Once Vaden was released from the hospital, he was transported to Southern Regional Jail. He is currently in Southern Regional Jail under a 25,000 dollar bond. He has been charged with second-degree sexual assault.
If convicted, he could serve 10 to 25 years in prison and face a fine of up to 10,000 dollars.
