GLEN JEAN, WV (LOOTPRESS) – A man faces charges in relation to an incident in which a woman was punched in the face earlier this month.
According to reports from the Fayette County Sheriff’s Department, Deputy Brian Fernandez was dispatched by Fayette County 911 to the Glen Jean Little General convenience store at 4704 Legends Highway, Glen Jean, WV for a Domestic Violence Complaint on Saturday, October 15, 2022.
Fayette 911 reported that the complaint pertained to an assault which occured in the Little General parking lot and that a male subject had busted a female’s nose.
Deputy Fernandez arrived on the scene at approximately 5:42pm, at which point Little General employees advised that the suspect was wearing a hat and a black hoodie over a pink shirt, and was in the parking lot at the time.
The female subject was located in an employee area behind the registers, and appeared to have blood running down her face and onto her shirt.
She stated that she had been struck in the face by the male.
Another female, identified as the male’s mother, Tina Francisco, stated she had witnessed the incident and corroborated the events as they had been described.
The male, later identified as Daniel Hicks, was outside the store at this time, and Corporal G.W. Rinehart of the Fayette County Sheriff’s Department was asked to initiate contact with Hicks and bring him back to the store.
The female subject voluntarily provided a written statement stating that she was sitting in the back of Francisco’s vehicle speaking to Hicks, who she purports had begun drinking at 11:00am that day and was intoxicated at the time of the incident.
At some point the conversation took a turn, and Hicks punched the female in the face with a closed fist, which she states broke her nose and split her lip, causing blood to begin spouting from the areas. At this point, the two females entered the store to contact 911.
Francisco, in a voluntary statement, asserted that Hicks became more aggressive as the conversation continued until he asked a question for which he did not like the response. It was at this point Hicks punched the female with his fist.
In speaking to Hicks, Deputy Fernandez did not receive a clear account of the events as they occurred, just that there was an argument which “got heated.”
Hicks further stated that the female was an alcoholic and that she had previously caused him to get stitches in his ear. He is said to have become extremely upset at times during the exchange, and there were no visible marks or signs of physical abuse on Hicks.
Photos were obtained of the female’s injuries, and a busted blood vessel in the left eye along with light bruising to both eyes was observed.
This is reported to have occurred during another incident in which Hicks had assaulted her in the weeks prior, and cell phone photos provided revealed heavy bruising to the face and body prior.
Hicks was determined to have been the primary aggressor in the incident, and was arrested on charges of Domestic Battery and transported to the Fayetteville Detachment of the Fayette County Sheriff’s Department for processing.
It was noted that Hicks has a previous conviction of Domestic Assault with a disposition date of 10/25/2017 through the Fayette County Magistrate Court.
During processing, Hicks stated that he had a broken hand and broken rib from pre existing injuries.
After processing, Hicks was transported to Plateau Medical Center in Oak Hill for Medical Clearance for Incarceration. Once cleared, he was transported to Southern Regional Jail.
