CHARLESTON, WV (LOOTPRESS) – The West Virginia House of Delegates has once again passed House Bill 2354, which seeks to ban specific food additives and dyes from products sold in the state.
The State Senate previously approved the bill but amended it to change the effective date from 2027 to 2028.

The House later concurred with this amendment while adding its own provision, exempting businesses that sell less than $5,000 worth of food containing the banned substances per month from criminal prosecution.
The bill passed the House by a vote of 79-17 and now returns to the Senate for final approval of the House amendment.
If enacted, the legislation will prohibit the use of the following additives and dyes in food products sold in West Virginia: butylated hydroxyanisole (BHA), propylparaben, FD&C Blue No. 1, FD&C Blue No. 2, FD&C Green No. 3, FD&C Red No. 3, FD&C Red No. 40, FD&C Yellow No. 5, and FD&C Yellow No. 6.
