RALEIGH COUNTY, WV (LOOTPRESS) – An 18-year-old Raleigh County teen is charged with sexually assaulting an underage female.
On Monday, April 14th, 2025, at about 11:05 hours, West Virginia State Police responded to a call involving a disturbance on Ritter Drive in Beaver, West Virginia. When the Police arrived, they made contact with an adult female, who seemed upset and was shouting. The witness told police she had spoken earlier that day with a man named Daniel Burger, who is the accused. This conversation took place in her daughter’s bedroom. The witness said her underage daughter was not there when she talked to the accused. Assuming a sexual encounter between the accused and the victim, the mother took the accused back to his home on Ritter Drive, where the disturbance had occurred.
Police briefly spoke with the underage victim about what happened at 112 Saunders Avenue. The underage victim admitted she had sex with the accused. During the encounter, the accused was injured after running from a window and fell. Police advised the accused of his rights through his Miranda rights. Officers asked if he was with the underage female, and he said he was not. Police told him the victim had said they were together. The accused then asked if the victim wanted to do it (have sex), and she answered yes. He asked if she was sure, and she confirmed. Police asked if he used protection, and he said he did not, because she wanted to get pregnant.
On Tuesday, April 22nd, 2025, at around 1:00 p.m., Police went to Just for Kids in Hill, West Virginia, for a forensic interview with the victim.
During the interview, the victim said the accused entered her bedroom through the window and wanted to talk. She told him to leave after an argument about her mother not approving of him. She said the accused then started kissing her neck and cheek. She pushed him away and told him to stop. She added that he grabbed her thigh and her arm, leaving bruises. She said she told him to stop and pushed him away, but he kept pulling her closer. She yelled for him to stop. The accused asked why, and she said she was still arguing. She said he then relaxed, and she started crying. He laid her on her bed while she cried and looked at the wall. She also said the accused pulled her shorts off. She flinched and tensed up, and he kept grabbing her.
Daniel Burger is charged with second degree sexual assault.
