FAYETTEVILLE, WV (LOOTPRESS) – A Virginia man was sentenced Monday on felony charges of Possession of Cocaine with Intent to Deliver.
Reports from Fayette County Prosecuting Attorney Anthony Ciliberti Jr. indicate that, on Monday, October 3, 2022, Charles D. Faltz of Courtland Virginia was sentenced to no less than 2 and no more than 30 years in prison on the possession charge to which the defendant pled guilty on July 22, 2022.
Faltz will be required to serve a minimum of two years before becoming eligible for parole.
The sentencing, which was carried about by Judge Thomas H. Ewing, stems from an October 7, 2021 incident in which a Fayette County Deputy Sheriff conducted a traffic stop on a vehicle being driven erratically.
Believing the driver to be under the influence of drugs or alcohol, or in the midst of a medical emergency, the deputy stopped the vehicle and approached the driver.
At this point, the deputy reported detecting the odor of marijuana. When questioned, the driver stated that there was both marijuana and cocaine inside the vehicle.
A subsequent search of the vehicle revealed four grams of cocaine, a small amount of marijuana, and small amounts of a substance revealed to be a mixture of heroin and fentanyl.
Additionally, two firearms were discovered in the vehicle. The defendant reportedly claimed ownership of the firearms as well as the substances.
The defendant was also revealed, through a background check, to have accrued prior felony convictions, rendering the possession of the firearms by the defendant unlawful.
The case was investigated by the Fayette County Sheriff’s Department and tried by Fayette County Prosecuting Attorney Anthony Ciliberti, Jr.Â
