BECKLEY, WV (LOOTPRESS) – The Raleigh County Commission has been notified of an impending lawsuit regarding the Raleigh County Circuit Clerk’s Office.
Lootpress sent a FOIA request to the Raleigh County Commission, and they provided us with the following information: Robert Dunlap Esq, PLLC, is representing six staff members from the Raleigh County Clerk’s Office: Kayla Workman, Susan Walker, Tara Meyer, Ashley Priddy, Chad McGrady, and James Paul Chapman.
The letter sent to the commission requests “1) all copies of all written communications from the Raleigh County Commission regarding any of the clients over the last two years, 2) any complaints or letters received from other individuals regarding the conduct of Bob McComas from the same time period, and 3) any notices or correspondence sent to Raleigh County Courthouse personnel from the Raleigh County Commission regarding the conduct of Circuit Clerk, Bob McComas; including the investigation of Mr. Jeff Shumate regarding statements and interviews.”
“In addition, allow this letter to serve as written notice that the Raleigh County Commission has an affirmative duty to preserve all evidence relating to the six clients. If a civil action is filed, failure to keep and preserve all such evidence may result in liability for the spoliation of evidence.”
Under WV Code §29B-1-3(d), the County Commission has five days to respond to the request.
James Paul Chapman has filed to run for the Circuit Clerk position due to Bob McComas stepping down.
