MONTGOMERY, WV (LOOTPRESS) – A 19-year-old Fayette County resident is facing a misdemeanor battery charge following an alleged assault at a Go-Mart in Montgomery.
According to a criminal complaint filed in Fayette County Magistrate Court, Tyleigh Overton, of Cannelton, is charged with one count of battery.
The complaint states that officers with the Montgomery Police Department were dispatched to the Go-Mart on Third Avenue at approximately 8:32 p.m. on June 13 in response to a reported battery.
According to the complaint, Overton allegedly confronted another individual as the person was walking into the store, threatened to shoot them, then chased the individual around the gas pumps and into the Go-Mart before repeatedly striking the person in the head with a closed fist. The complaint states the individual attempted to protect themselves and did not fight back.
Police said employees inside the store told officers they witnessed the altercation and reported that Overton struck the individual several times in the face before employees intervened and called 911.
The complaint further states the individual told officers the incident was part of an ongoing dispute and alleged that Overton and some of Overton’s friends had previously made threats and circled the individual’s residence on separate occasions.
According to the complaint, officers obtained and reviewed surveillance video from the incident on June 15. Investigators said the footage showed no firearm was involved but did show Overton following the individual into the store before allegedly striking them several times. The complaint states the altercation was broken up by Go-Mart employees before police were called.
Based on the investigation, authorities charged Overton with one count of misdemeanor battery.
A criminal complaint is merely an allegation, and all defendants are presumed innocent unless and until proven guilty in a court of law.
