CHARLESTON, WV (LOOTPRESS) – A bill aimed at limiting the use of Supplemental Nutrition Assistance Program (SNAP) benefits for purchasing candy and soft drinks is making its way through the West Virginia House of Delegates.
House Bill 2350, sponsored by Delegate Adam Burkhammer (R-Lewis), would require the West Virginia Department of Human Services to seek a waiver from the U.S. Department of Agriculture (USDA) to remove candy and soft drinks from the list of eligible food items that can be purchased using SNAP benefits.
If the waiver is denied, the department would be required to reapply annually until approval is granted.
As of Feb. 19, 2025, the bill is in the markup process in the House Health and Human Resources Committee.
Lawmakers are reviewing the legislation through a process that includes questioning legal counsel, considering amendments, and holding a committee vote.
If passed, the bill would amend state law by adding a new section, §9-2-14, to enhance nutrition in the SNAP program. Definitions for “candy” and “soft drinks” would align with existing state tax code language.
The bill comes following a proposal from the U.S. Health and Human Services Secretary Robert F. Kennedy Jr, who has voiced interest in a nationwide ban on such purchases using SNAP benefits.
SNAP is a $113 billion program that serves roughly 42 million Americans.
