MCDOWELL COUNTY, WV (LOOTPRESS) – A federal inmate in McDowell County is asking the courts to overturn his conviction and release him from jail because of President Biden’s Administration’s Immigration policy.
Inmate Darrell Miller argues that he is being incarcerated because he tried to move or attempted to move an undocumented immigrant within the United States. Â He argues that on May 2022, Texas Governor Greg Abbott started transporting busloads of undocumented aliens to Washington D.C. and New York. Â Miller says his sentence is a moot point due to the change in the policies by the White House and would be a violation of his constitutional rights. Â He is asking to be released from prison immediately, his supervised release will be suspended, and his records expunged.
Miller argues that when he was sentenced under the Trump Administration and once Biden became President, the transportation of undocumented aliens was no longer a punishable crime.
Miller is serving a 36-month term in McDowell County FCI and will do 24 months of supervised release.
At the end of the letter, Miller wrote, “What’s good for the goose is good for the gander.”
