CHARLESTON, WV (LOOTPRESS) – The West Virginia House of Delegates on Monday passed a bill that would permit the sale of raw milk.
House Bill 4911, introduced by Delegate Mike Hornby (R-Berkeley), would allow individuals and businesses to sell raw milk in West Virginia.
The bill permits the sale of raw milk as long as the containers are clearly labeled as ungraded raw milk, with the name of the seller and the date of production.
Delegates who spoke against the bill stated they were not against the sale of raw milk, but were concerned about the level of immunity that is provided to sellers within the bill.
The bill states that if someone sells raw milk, you can’t be sued or held responsible for any harm or problems that might happen because of it. However, this protection doesn’t apply if you deliberately or recklessly cause harm on purpose.
Following debate on the House floor, the bill passed on a 76-19 vote. The bill now goes to the Senate for consideration.
