PRINCETON, WV (LOOTPRESS) – A Mercer County jury has found Charles Glen Nicholson, a 55-year-old Princeton resident, guilty of felony driving on a revoked license for DUI, marking his third offense.
The conviction came after a circuit court jury trial, where evidence was presented showing Nicholson was driving with a revoked license due to a previous DUI conviction.
According to Mercer County Prosecuting Attorney Brian K. Cochran, the conviction followed an incident in which a West Virginia State Police Trooper pulled Nicholson over for a traffic violation and discovered that his license had been revoked.
Assistant Prosecuting Attorney Brandon Austin presented additional evidence that Nicholson had multiple prior convictions in Mercer County for driving on a revoked license for DUI.
Cochran commended both the State Police and Austin for their efforts in bringing the case to a close.
“The State Police did a great job on this case, and Brandon Austin worked hard putting all of the evidence together for the jury after plea negotiations were unsuccessful,” Cochran said.
Nicholson, who faces a sentence of 1-3 years in prison, will be sentenced by Circuit Court Judge William Sadler in January 2025.
Reflecting on the case, Cochran noted that his office has tried around 30 jury trials but rarely sees cases of this nature go to trial.
“We’ve tried a ton of serious cases and take all crimes seriously, but most of these types of cases that was tried today can and should be reasonably resolved without a trial,” he said.
“But in this case, my office had no other option but to let the jury decide this case because that is what Mr. Nicholson wanted.”
