RANDOLPH COUNTY, WV (LOOTPRESS) – One man has been arrested after receiving his third driving while suspended offense.
According to the Randolph County Sheriff’s Office, on November 11, 2023, Deputies were conducting interdiction traffic patrol in the area of U.S. Rt 219 near the Sheet intersection.
Deputies then observed a silver in color Chevy Sedan exiting the shopping plaza, and then turning right onto U.S. Rt. 219 Southbound, the aforementioned vehicle was being operated after dark with the front passenger side headlight out.
Deputies then activated their emergency lights and siren and conducted a traffic stop in the Newlans parking lot just off Ward Road.
Deputies then approached the male driver and advised him of the reason for the traffic stop.
The driver then identified himself as Cody Simmons, the defendant, and stated that he didn’t have a valid driver’s license due to a suspension for unpaid citations.
Deputies then obtained his certificate of insurance and registration.
Deputies were then advised by Randolph E-911 that the defendant’s license was in fact actively suspended. After running his criminal history through E-911, police were only able to confirm one prior charge.
Police then issued the defendant a written warning for the defective headlight, and advised him that law enforcement was going to obtain his certified driving history and compile this criminal complaint for Driving Suspended 3rd Offense after verifying his convictions.
On November 12, 2023, this Officer confirmed through the W.V. Supreme Court Of Appeals Portal that he has two prior driving suspended charges, one with a conviction date of 01/27/2017, and the second with a conviction date of 06/28/2021, making this his third or subsequent offense.
He was then arrested and is currently out on bond.
