FAYETTEVILLE, WV (LOOTPRESS) – A 57-year-old Fayette County man was sentenced to prison following an investigation into a purported ongoing sexual relationship with a 14-year-old female neighbor which continued until the victim was 15 years old.
According to Prosecuting Attorney for Fayette County, Anthony Ciliberti, Jr., on May 31, 2021, the Oak Hill Police Department responded to parent reports of a child having been in a sexual relationship with an adult neighbor.
The victim underwent interview proceedings at the Just For Kids Child Advocacy Center where she disclosed that she had begun a sexual relationship with James R. McMillion – 57 years old, formerly of Oak Hill, WV – when she was fourteen. The victim advised that the relationship continued until she was fifteen years old.
Based on an investigation by the Oak Hill Police Department Detective Bureau, in conjunction with support provided through Just Fork Kids Child Advocacy Center and prosecution of the case by Ciliberti Jr., McMillion was sentenced by Circuit Court Judge Thomas H. Ewing for two counts of felony third-degree sexual assault on October 23, 2023.
McMillion plead guilty to the charges on June 1, 2023, and has been sentenced to one to five years in prison for each offense, with the sentences having been ordered to be carried out concurrently. McMillion will serve a minimum of two years before potentially becoming eligible for parole.
Additionally, McMillion will be subject to twenty years of extended supervised release, and a period of extended supervised release may be changed to a prison term should McMillion violate the conditions of the release. McMillion must also register as a sex offender for the remainder of his life.
