WYOMING COUNTY, WV (LOOTPRESS) – A couple has been sentenced to prison in connection to an overdose death in Wyoming County, after failing to render aid.
Penny Sue Biggs, 49, and Wallace Mason Biggs, 55, of Mullens, WV each pled guilty in December to one count of Failure to Render Aid.
On February 28, 2023, the Court sentenced them each to 1 to 5 years in prison.
Wallace and Penny Biggs were using illegal controlled substances with the victim when the victim overdosed. Wallace and Penny Biggs then placed the victim beside the roadway and left the scene.
Gregory Bishop is the Wyoming County Prosecutor.
“The facts of this case are extremely disturbing,” said Bishop, “This is a prime example of how drug use not only contributes to crime, but elevates crime to utterly horrific levels.”
Derek Laxton, Wyoming County Assistant Prosecutor, served as lead prosecutor in the case.
The Wyoming County Sheriff’s Department and Mullens’ Police Department investigated the crimes.
Bishop wished to thank the hard and thorough work of Derek Laxton and the entire prosecutor staff along with the Wyoming County Sheriff’s Department and Mullens’ Police Department. “The cooperation between law enforcement agencies in this investigation was noteworthy,” said Bishop.
